AN ORDINANCE AMENDING CERTAIN SECTIONS OF THE HEALTH AND SANITATION CODE, CHAPTER 14-47, OF THE CITY OF WEST PLAINS, MISSOURI

 

WHEREAS, the City of West Plains, Missouri is empowered and authorized to make and adopt city code; and

 

WHEREAS, The City Council of the City of West Plains, Missouri has determined that certain sections of the Health and Sanitation Code, Chapter 14-47 of the City of West Plains, Missouri need to be amended and that it would be in the best interests of the City of West Plains, Missouri to do so.

 

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

 

            Section 1:         That the following sections are added to Chapter 14-47, to include the requirement of a food handler’s permit for all employees and employers of such person who prepares, handles, or disperses food for human consumption.

 

                        14-47 (r) (1) Every employee and every employer of such person who prepares, handles, or disperses food for human consumption, or who comes into contact with food or food preparation utensils, shall within 30 calendar days of employment as a food handler or from the date of commencing the business of a food establishment, under the direction of the Health Authority, obtain a food handler permit.  Permanent two (2) year permits shall be issued upon completion of a food handler’s training course conducted by the Health Department of the City of West Plains, or by completion of any other food handlers training course which is approved by the Health Authority of the City of West Plains, and payment of a $3.00 permit fee.  Permits shall be renewed every two (2) years.  However, such $3.00 permit fee shall not be charged to those persons who are working without compensation for religious, charitable or nonprofit organizations, or persons age 65 or older.  A copy of such permit shall be deposited with the management of the establishment during the tenure of that person’s employment.  Employees and employers of any retail establishment, which handles only packaged foods, are exempt from this requirement.  The person in charge must be able to demonstrate knowledge of foodborne disease prevention, applications of HACCP-Hazard Analysis & Critical Control Points principles and requirements of the 1999 Missouri Food Code and any subsequent codes adopted by the City of West Plains.  This may be demonstrated by compliance with the code, or by having passed an approved food protection program (such as Serv-Safe), or by responding correctly to the inspector’s questions.

 

(2)   The food handler’s permit shall be carried at all times by the holder thereof while engaging in the work of a food handler, and shall be displayed upon demand of the Health Authority, when demand is made therefore.  Failure to exhibit valid food handler’s permit to the Health Authority shall be presumptive evidence that said person is not a duly licensed food handler.  Establishments are responsible for maintaining and updating their list of employees’ Food Handlers Permits every three months.  Management staffing completing Food Safety Certification program will not be required to obtain a Food Handlers Permit.

 

(3)   Upon witnessing a violation of this Chapter, the Health Authority may immediately suspend and repossess the offending food handler’s food handling permit. 

 

(4)   It shall be unlawful for any employer to allow a food handler to work in a food service establishment in violations of Sections 1, 2 or 3 of this amendment.

 

(5)  Duplicate cards shall be issued at a cost of $2.00 per duplication.

 

            Section 2:  After passage and approval, this Ordinance shall be in full force and effect beginning January 1, 2002 and will be strictly enforced beginning January 1, 2003.
