BILL NO. 3760 ORDINANCE

AN ORDINANCE ADDING SECTION 90-563 TO THE CODE OF THE CODE OF ORDINANCES OF THE CITY OF WEST PLAINS, MISSOURI (ATV – LIABILITY INSURANCE REQUIRED)

WHEREAS, The City Council of the City of West Plains, Missouri has determined that it would be in the best interests of the City of West Plains, Missouri to add a new section to the code requiring liability insurance for all terrain vehicles (ATV).

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

Section 1: That the following section is hereby added to the code of ordinances for the City of West Plains.

Section 90-563 Liability Insurance Required

No permit to operate an all-terrain vehicle on city streets shall be issued to an applicant therefor by the city clerk until such applicant has filed with the city clerk an all-terrain vehicle liability insurance policy with some insurance company authorized to transact business in Missouri. Liability insurance for all-terrain vehicles shall bind the obligor thereunder to make compensation in the following amounts and conditions:

a) Minimum of $25,000 because of bodily injury to or death of one person in any one accident and subject to such limit for one person.

b) $50,000.00 because of bodily injury to or death of two or more persons in any one accident.

c) $10,000.00 because of injury to a destruction of property of others in any one accident.

d) Additional required coverage shall be underinsured motorist-bodily injury in the amount of $25,000.00 per person and $50,000.00 per accident.

e) The policy shall contain a provision that it may not be cancelled without providing at least 20 days’ notice to the city.

Section 2: That this Ordinance shall be in full force and effect ten days after its passage and approval.
