AN ORDINANCE VACATING A PORTION OF GOOD HARD DRIVE RIGHT-OF-WAY (HOME BUILDER’S ASSOCIATION)

WHEREAS, a petition has heretofore been filed by the Home Builder’s Association to vacate a portion of Good Hard Drive.  Petitioners state that they are the owners of all property adjacent to said portions of right-of-way to be vacated, that said right-of-way is not needed for use as such by the public, and that the property rights of others in the adjacent areas are not affected in the vacating of said portions of the right of way further described as follows:

A part of the SW ¼ of Section 16, Township 24 North, Range 8, West described as follows:

All that part of a public road adjacent to the south side of Lots 6, 7, 8, 9, and 10 (retaining all utility easements) and adjacent to the west side of lots 10 and 11 of Powels Subdivision as recorded in Plat Book B, Page 8 of the records of Howell County, Missouri.

WHEREAS, a public hearing was held on June 17, 2002 and notice of said hearing was published in the West Plains Quill on June 3, June 10, and June 12, 2002; and

WHEREAS, the City Council finds that it would be appropriate to vacate a portion of Good Hard Drive as described.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

Section 1: That the above-described street right-of-way is hereby vacated.

Section 2: That this Ordinance shall be in full force and effect ten days after its date of passage and approval as provided by law.
