BILL 3774 ORDINANCE ______
AN ORDINANCE OF THE CITY OF WEST PLAINS, MISSOURI DIRECTING THAT THE QUESTION OF WHETHER A COMMISSION SHOULD BE CHOSEN TO FRAME A CHARTER FOR THE CITY OF WEST PLAINS AND THE LIST OF CANDIDATES FOR THAT COMMISSION SHALL BE PLACED ON THE BALLOT FOR THE APRIL 2003 ELECTION.
WHEREAS, Article 6, Section 19 of the Constitution of the State of Missouri allows a city such as West Plains to frame and adopt a charter for its own government, and
WHEREAS, the Chamber of Commerce and various citizens of the City of West Plains have indicated a desire to have such a matter placed on the April 2003 ballot, and
WHEREAS, the council members of the City of West Plains, Missouri believe that such an issue should be put to public vote.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI, AS FOLLOWS:
Section 1: The following question shall be submitted to the voters of the City of West Plains, Missouri, in the April 2003 election, “Shall a commission be chosen to frame a charter?”
Section 2: The ballot for the April 2003 election shall also contain the names or groups of names of the electors of the city who are candidates for the commission, said candidates having qualified pursuant to Section 19 of Article 6 of the Constitution of the State of Missouri. If a majority of the electors voting on the question contained in section 1 vote in the affirmative, the thirteen (13) candidates receiving the highest number of votes shall constitute the commission.
Section 3: If said question posed is voted in the affirmative, the thirteen (13) candidates receiving the highest number of votes shall, as the commission, meet and deliberate as is necessary to draft a charter that may then be submitted to the electorate for approval pursuant to Section 19 of Article 6 of the Constitution of the State of Missouri. The City shall pay all necessary expenses of the commission.
Section 4: That this ordinance shall be in full force and effect from and after its passage and approval.
