AN ORDINANCE VACATING A PORTION OF HARRISON CIRCLE CUL-DE-SAC (BRILL, FINCH, BAILEY, SMITH)

 

WHEREAS, a petition has heretofore been filed by James Brill, Penelope Brill, Elmer Finch, Joy Finch, David Bailey, April Bailey, Noel Smith, and Ruth Smith to vacate part of Harrison Circle cul-de-sac.  Petitioners state that they are the owners of all property adjacent to said portions of right-of-way to be vacated, that said streets are not needed for use as such by the public, and that the property rights of others in the adjacent areas are not affected in the vacating of said portions of the streets further described as follows:

 

Tract #1:  A part of the cul-de-sac at the end of Harrison Circle in Block 2 of Suburban Estates First Addition, as shown in Plat Record G, at pages 85 and 86 of the records of Howell County, Missouri, more particularly described as follows:  Commencing at the southwest corner of Lot 12, Block 2, thence North 14°48’59”West, 102.52 feet to the POINT OF BEGINNING:  thence along the arc of a curve to the left 76.06 feet, said curve having a radius of 60.00 feet and a chord bearing North 14°36’24” East; thence South 68°17’26” West, 19.86 feet; thence along the arc of a curve to the right 48.76 feet, said curve having a radius of 50.00 feet and a chord bearing South 04°17’26” West, 19.86 feet; thence along the arc of a curve to the right 48.76 feet, said curve having a radius of 50.00 feet and a chord bearing South 04°06’29” West; thence South 14°48’59: East, 15.20 feet to the point of beginning containing 1,063.8 sq. ft. more or less as shown by survey no. 02045 by Burgess Land Surveying, L.L.C.

 

Tract #2:  A part of the cul-de-sac at the end of Harrison Circle in Block 2 of Suburban Estates First Addition, as shown in Plat Record G, at pages 85 and 86 of the records of Howell County, Missouri, more particularly described as follows:  Commencing at the southwest corner of Lot 12, Block 2, thence North 14°48’59” West, 102.52 feet; thence along the arc of a curve to the left 76.06 feet, said curve having a radius of 60.00 feet and c chord bearing North 14°36’24” East to the POINT OF BEGINNING:  thence along the arc of a curve to the left 112.69 feet, said curve having a radius of 60.00 feet and a chord bearing North 75°30’56” West; thence South 39°19’18” East 9.78 feet; thence along the arc of a curve to the right 82.06 feet, said curve having a radius of 50.00 feet and a chord bearing South 70°51’01” East; thence north 68°17’26” East, 19.86 feet to the point of beginning containing 1,615.4 sq. ft. more or less as shown by survey no. 02045 by Burgess Land Surveying, L.L.C.

 

Tract #3:  A part of the cul-de-sac at the end of Harrison Circle in Block 2 of Suburban Estates First Addition, as shown in Plat Record G, at page 85 and 86 of the records of Howell County, Missouri, more particularly described as follows:  Commencing at the southwest corner of Lot 12, Block 2, thence North 14°48’59” West, 102.52 feet; thence along the arc of a curve to the left 188.75 feet, said curve having a radius of 60.00 feet and a chord bearing North 39°11’ 58” West to the POINT OF BEGINNING:  thence along the arc of a curve to the left 86.97 feet, said curve having a radius of 60.00 feet and a chord bearing South 09°08’55” West; thence along the arc of a curve to the right 82.47 feet, said curve having a radius of 50.00 feet and a chord bearing North 14°52’27” East; thence North 39°19’18” West, 9.78 feet to the point of beginning containing 297.8 sq. ft. more or less as shown by survey no. 02045 by Burgess Land Surveying, L.L.C.

 

Tract #4:  A part of the cul-de-sac at the end of Harrison Circle in Block 2 of Suburban Estates First Addition, as shown in Plat Record G, at pages 85 and 86 of the records of Howell County, Missouri, more particularly described as follows:  Commencing at the southwest corner of Lot 12, Block 2, thence North 14°48’59” West 102.52 feet; thence along the arc of a curve to the left 275.72 feet, said curve having a radius of 60.00 feet and a chord bearing North 80°43’10” West to the POINT OF BEGINNING:  thence along the arc of a curve to the left 49.90 feet, said curve having a radius of 60.00 feet and a chord bearing south 56°12’12” East; thence North 14°36’50” West, 3.94 feet; thence along the arc of a curve to the right 47.35 feet, said curve having a radius of 50.00 feet and a chord bearing North 59°29’42” West to the point of beginning containing 61.0 sq. ft. more or less as shown by survey no. 02045 by Burgess Land Surveying. LLC.

 

WHEREAS, a public hearing was held on November 25, 2002 and notice of said hearing was published in the West Plains Quill on November 11, 2002; and

 

WHEREAS, the City Council finds that it would be appropriate to vacate a portion of Harrison Circle cul-de-sac.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

 

Section 1: That the above-described portion of Harrison Circle cul-de-sac is hereby vacated.

 

Section 2: That this Ordinance shall be in full force and effect ten days after its date of passage and approval as provided by law.
