AN ORDINANCE CHANGING THE OFFICIAL ZONING MAP OF THE CITY OF WEST PLAINS, MISSOURI AND DEFINING THE BOUNDARIES OF THE AREA TO BE CHANGED ON SAID OFFICIAL ZONING MAP BY THIS ORDINANCE (SLOAN, ACKLIN, SULLIVAN - 1152 GARFIELD, 1156 LINCOLN, 1149 LINCOLN)

WHEREAS, Alma Sloan, Dennis Sloan, Aubrey Sloan, Audrey Ott, Phyllis Collins, Warren Sullivan, Sherley Sullivan, and Georgia Acklin petitioned the Planning Commission of West Plains, Missouri seeking to have properties located at 1152 Garfield, 1156 Lincoln, and 1149 Lincoln changed from R-2 (Urban Residential) to C-2 (General Commercial) zone.  The property is further described as follows:

 

Sloan Tract:  All of Lot 6 of Padon’s Subdivision of the E1/2 of the NW ¼ of Section 21, Township 24, Range 8.  Also 132 feet off the north side of Lots 7 and 8 in Padon’s Survey of the E1/2 of the NW ¼ of Section 21, Township 24, Range 8, EXCEPT therefrom beginning at the northwest corner of said Lot 7, thence east 214.8 feet, thence south 132 feet, thence west 214.8 feet, thence north 132 feet to the point of beginning of this exception.

 

Sullivan Tract:  Lots 1 and 2 in Block 3 of Toler’s Subdivision of a part of the W1/2 of the NW ¼ and a part of the NW ¼ of the SW ¼ of Section 21, Township 24, Range 8.  A part of the NW ¼ of the NW ¼ of Section 21, Township 24, Range 8 described thus:  Beginning at the point where the west line of Lincoln Avenue intersects the south line of county road which is an extension of Abe Taylor Street, which point of intersection is near the northeast corner of said NW ¼ of NW ¼, thence south along the west line of Lincoln Avenue a distance of 200 feet, which is the beginning point of this survey, thence south along the west line of Lincoln Avenue 100 feet, thence west 200 feet, thence north 100 feet, thence east 200 feet to the place of beginning, being also known as Lot 3 in Block 3 of Toler’s Subdivision of a part of the W1/2  of the NW ¼ and a part of the NW ¼ of the SW1/4 of Section 21, Township 24, Range 8.

 

Acklin Tract:  Lots 9 and 10 in Block 3 of Toler’s Subdivision a part of the W1/2 of the NW ¼ and part of the NW ¼ of the SW ¼ of Section 21, Township 24 North, Range 8 West, EXCEPT a strip 11 feet wide of even width off the entire north side of said Lot 9.

 

            WHEREAS, the Planning Commission recommended the request be granted; and

 

            WHEREAS, a public hearing was held on November 25, 2002 concerning the rezone request with a public notice published in the West Plains Daily Quill on November 13, 2002.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

 

            Section 1: That the zoning classification for property described above and which is situated in the City of West Plains, Missouri, be and hereby is changed so as to include the property described above as zone classification C-2 (General Commercial).

 

            Section 2: That boundary lines of the Official Zoning Map of the City of West Plains, Missouri, be and hereby are changed so as to include the property described above as zone classification C-2 (General Commercial).

 

            Section 3: That the official zoning map of the City of West Plains, Missouri be and the same is hereby changed in accordance with the boundary changes of zone districts as herein above set forth Ordinance and the map shall be signed by the Mayor and attested by the City Clerk.

 

            Section 4: That this Ordinance shall be in full force and effect on and after its passage and approval.
