AN ORDINANCE CHANGING THE OFFICIAL ZONING MAP OF THE CITY OF WEST PLAINS, MISSOURI AND DEFINING THE BOUNDARIES OF THE AREA TO BE CHANGED ON SAID OFFICIAL ZONING MAP BY THIS ORDINANCE (PHYSICIAN’S ACUMEN ENTERPRISES, R-2 TO C-2)

WHEREAS, Physician’s Acumen Enterprises petitioned the Planning Commission of West Plains, Missouri seeking to have the property located on South Business 63 changed from R-2 (Urban Residential) to C-2 (General Commercial) zone.  The property is further described as follows:

 

A part of the NE1/4, a part of the NW1/4 of the SE1/4; a part of the NE1/4 of the SW1/4, and a part of the SE1/4 of the NW1/4, all in Section 27, Township 24 North, Range 8 West, described as follows:  Commencing at the Northwest Corner of said Section 27, thence South 1°13’00”West, 264.0 feet, thence South 88°42’07” East, 917.40 feet; thence South 3°49’56” West, 21.8 feet to a point on the south edge of the Old West Plains and Thomasville Road (now known as County Road No. 8240), thence South 89°00’12” East, 139.87 feet, thence North 88°17’53” East, 132.92 feet to the southern right-of-way line of the Burlington Northern Railroad; thence southeasterly along said southern right-of-way line South 57°51’39” East, 2,931.03 feet; thence along the arc of a curve to the right 312.80 feet, said curve having a radius of 2814.80 feet and a chord bearing South 55°20’17” East; thence South 54°00’20” West, 1653.51 feet to the west line of the NW1/4 of the SE1/4, being the Incorporated Limits of West Plains, Missouri and the POINT OF BEGINNING:  thence along the west line of the NW1/4 of the SE1/4 and along the west line of the SW1/4 of the NE1/4, being the Incorporated Limits of West Plains, Missouri, North 01°08’00” East, 882.83 feet, thence South 51°02’31” West, 423.96 feet to the east right-of-way line of Business Route 63, thence along said east right-of-way line the following 4 courses

  1. South 36°21’16” East, 26.60 feet,
  2. thence South 24°46’32” East, 99.99 feet;
  3. thence South 13°47’17” East 101.58 feet;
  4. thence South 25°00’08” East, 471.89 feet,

thence North 54°00’20” East, 38.18 feet to the point of beginning containing 3.63 acres more or less.

 

            WHEREAS, the Planning Commission recommended the request be granted; and

 

            WHEREAS, a public hearing was held on December 16, 2002 concerning the rezone request with public notices published in the West Plains Daily Quill on December 2, 2002.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

 

            Section 1: That the zoning classification for property described above and which is situated in the City of West Plains, Missouri, be and hereby is changed so as to include the property described above as zone classification C-2 (General Commercial).

 

            Section 2: That boundary lines of the Official Zoning Map of the City of West Plains, Missouri, be and hereby are changed so as to include the property described above as zone classification C-2 (General Commercial).

 

            Section 3: That the official zoning map of the City of West Plains, Missouri be and the same is hereby changed in accordance with the boundary changes of zone districts as herein above set forth Ordinance and the map shall be signed by the Mayor and attested by the City Clerk.

 

            Section 4: That this Ordinance shall be in full force and effect on and after its passage and approval.
