AN ORDINANCE VACATING A PORTION OF BRATTON AVENUE (INDUSTRIAL DEVELOPMENT CORPORATION FOR ARLEE HOME FASHIONS)

WHEREAS, a petition has heretofore been filed by the Industrial Development Corporation to vacate part of Bratton Avenue. Petitioners state that they are the owners of all property adjacent to said portions of right-of-way to be vacated, that said street is not needed for use as such by the public, and that the property rights of others in the adjacent areas are not affected in the vacating of said portion of the street further described as follows:

A part of the SW1/4 of the SW1/4 of Section 22, Township 24 North, Range 8 more particularly described as follows:

All that part of Bratton Avenue right-of-way lying north of and adjacent to the tract of land described in Cabinet B., Drawer 4, Page 1934, dated May 15, 1989 of the records of Howell County, Missouri

WHEREAS, a public hearing was held on January 9, 2003 and notice of said hearing was published in the West Plains Quill on December 20, 2003; and

WHEREAS, the City Council finds that it would be appropriate to vacate a portion of Bratton Avenue.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

Section 1: That the above-described portion of Bratton Avenue is hereby vacated.

Section 2: That this Ordinance shall be in full force and effect ten days after its date of passage and approval as provided by law.
