AN ORDINANCE VACATING AN ALLEY BETWEEN WEST BROADWAY AND WEST FIRST STREET (LARRY WOOLMAN, RICHARD HILL, CARLENE HILL, G. E. GRISHAM, PHYLLIS PARIS, AND MARVEEN JOPLIN)

 

WHEREAS, a petition has heretofore been filed by Larry Woolman, Richard Hill, Carlene Hill, G. E. Grisham, Phyllis Paris, and Marveen Joplin to vacate an alley between West Broadway and First Street.  Petitioners state that they are the owners of all property adjacent to said portions of alley to be vacated, that said street is not needed for use as such by the public, and that the property rights of others in the adjacent areas are not affected in the vacating of said portion of the alley further described as follows:

 

A part of the SW1/4 of Section 20, Township 24 North, Range 8 West.  All that part of the alley shown in the Mo-Ark addition as recorded in Plat Book D at Page 110 of the records of Howell County, Missouri, that lies east of and adjacent to Block 1.

 

WHEREAS, a public hearing was held on November 13, 2003 and notice of said hearing was published in the West Plains Quill on November 10, 2003; and

 

WHEREAS, the Planning Commission found and City Council finds that it would be appropriate to vacate an alley between West Broadway and West First Street retaining any utility easements.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:

 

Section 1: That the above-described alley between West Broadway and West First Street is hereby vacated with the City retaining any utility easements.

 

Section 2: That this Ordinance shall be in full force and effect ten days after its date of passage and approval as provided by law.
