A RESOLUTION AUTHORIZING THE CONVEYANCE OF REAL ESTATE BY THE CITY OF WEST PLAINS, MISSOURI, A MUNICIPAL CORPORATION, TO SOUTHERN MISSOURI CHAPTER OF THE NATIONAL ASSOCIATION OF HOME BUILDERS, A MISSOURI NOT FOR PROFIT CORPORATION.

 

     WHEREAS, the Southern Missouri Chapter Of The National Association Of Home Builders constructed and donated the Welcome and Visitor Center to the City of West Plains and the City of West Plains presently holds unencumbered title to the Welcome and Visitor Center; and

 

     WHEREAS, the City of West Plains is currently obligated under a Guaranty on a loan from First National Bank to the Southern Missouri Chapter Of The National Association Of Home Builders with a balance of approximately $36,000.00 representing the balance owed on the Welcome and Visitor Center; and

 

WHEREAS, the Southern Missouri Chapter Of The National Association Of Home Builders is active in promoting the growth and economic development of the City of West Plains; and

 

     WHEREAS, the Southern Missouri Chapter Of The National Association Of Home Builders is currently occupying part of the Welcome and Visitor Center but needs a location on which to construct its own headquarters.

 

     NOW, THEREFORE, BE IT RESOLVED by the City Council of West Plains, Missouri, as follows:

 

     Section 1.  REAL ESTATE TO BE CONVEYED.  That in accordance with the terms of this resolution, the Mayor and City Clerk of the City of West Plains, Missouri, are authorized to execute the attached warranty deed conveying to the Southern Missouri Chapter Of The National Association Of Home Builders the following described real estate located in the City of West Plains, Howell County, Missouri:

 

All that part of Powles Subdivision as recorded in Plat Book B, at Page 8 in the records of Howell County, Missouri, that lies South, West & Southwest of the following described line:

 

Commencing at the Southwest corner of Section 16, Township 24 North, Range 8 West, thence Easterly along the South line of Section 16 a distance 669.3 feet, thence angle left 90 degrees 25 minutes 40 seconds for a distance of 43.0 feet to a point on the west line of the tract of land described in Warranty Deed Book 399, Page 65 of the records of Howell County, Missouri, and the point of beginning, thence angle left 78 degrees 13 minutes 10 seconds for a distance of 255.2 feet, thence angle right 27 degrees 46 minutes 50 seconds for a distance of 178.22 feet, thence angle right 3 degrees 57 minutes 40 seconds for a distance of 171.75 feet, thence angle left 5 degrees 16 minutes 55 seconds for a distance of 171.75 feet to the East right-of-way line of Luna Drive, EXCEPT all that part of the above described tract now being used as US Hwy 160 right-of-way.

 

Subject to easements and restrictions of record.

 

     Section 2.  DEMOLITION OF EXISTING BUILDING.  That the Southern Missouri Chapter Of The National Association Of Home Builders shall within six months from the date of this resolution remove the existing building on the above described real estate.

 

     Section 3.  RELEASE FROM DEBT.  That the Southern Missouri Chapter Of The National Association Of Home Builders shall use the above described land as security for its loan at First National Bank and the City of West Plains will be released from further obligation on that loan.    

 

     Section 4.  CONTINUED USE OF ROOM.  That the Southern Missouri Chapter Of The National Association Of Home Builders shall be allowed to occupy its present room at the Welcome and Visitor Center on the same terms and conditions as presently exist until such time as it constructs its own headquarters on the above described real estate.

    

Section 5.  This resolution shall be in full force and effect as of the date of its passage.

 

     PASSED AND APPROVED this 14th day of January, 2002.
