A RESOLUTION TO APPROVE THE EXECUTION OF COMMUNITY DEVELOPMENT BLOCK GRANT DOCUMENTS FOR CARLSON GARDNER, INC
Section 1: That the City Council of the City of West Plains, Missouri does hereby authorize the execution of grant documents for Carlson Gardner, Inc. attached herein and made a part of this Resolution (Exhibits A and B).
Section 2: That this Resolution shall be in full force and effect after its days of passage and approval.

The City
of West Plains will replace all occupied and vacant occupiable
low/moderate-income dwelling units demolished or converted to use other than
low/moderate income housing as a direct result of activities assisted with funds
provided under the Housing and Community Development Act of 1974, as amended.
All replacement housing will be provided within three years of the demolition of conversion. Before obligating or expending funds that will directly result in such demolition or conversion, the City of West Plains will make public and submit, to the CDBG program, the following information in writing:
1. A description of the proposed assisted activity;
2. The general location on a map and approximate number of dwelling units by size (number of bedrooms) that will be demolished or converted to a use other than low/moderate-income dwelling units as a direct result of the assisted activity;
3. A time schedule for the commencement and completion of the demolition or conversion;
4. The general location on a map and approximate number of dwelling units by size (number of bedrooms) that will be provided as Section 104(d) replacement dwelling units;
5. The source of funding and a time schedule for the provisions of Section 104(d) replacement dwelling units; and
6. The basis for concluding that each Section 104(d) replacement dwelling unit will remain a low/moderate income dwelling unit for at least 10 years from the date of initial occupancy.
The City of West Plains will provide relocation assistance, as described in Section 570.488, to each low/moderate-income household displaced by the demolition of housing or by the conversion of a low/moderate-income dwelling to another use as a direct result of assisted activities.
Consistent with the goals and objectives of activities
assisted under the Act, the City of West Plains will take the following steps
to minimize the displacement of persons from their homes: by
designing the proposed public facilities in such a manner so as not to displace
any persons.
Based on initial review of project, the following occupied
dwellings (by address) will be demolished or converted with grant funds: there
are no occupied dwellings that will be demolished with grant funds.
EXHIBIT B
CO-APPLICANT AGREEMENT

City of West Plains, Missouri
and
Carlson Gardner, Inc.
NOW ON THIS __25___ day of ___March____, 2002 comes the City of West Plains, Missouri, acting by and through its duly elected Mayor and Council, hereinafter referred to as City, and also comes Carlson Gardner, Inc. a real estate development company, acting by and through its duly appointed Board of Directors, hereinafter referred to as CGI agrees as follows:
W I T N E S S E T H
WHEREAS, the parties hereto, the City and CGI desire to increase the availability of safe affordable housing for the benefit of the residents of West Plains, Missouri, and
WHEREAS, CGI is a duly formed corporation of the State of Missouri, and
WHEREAS, the parties to this agreement desire to work together in a cooperative effort to obtain funding for the acquisition of real estate to construct a 40 unit low to moderate income residential housing complex;
NOW, THEREFORE, the parties to this agreement agree as follows:
1. The City agrees to make application as sponsoring agency for a Community Development Block Grant for the benefit of the low to moderate income persons in the West Plains area to provide additional affordable housing units.
The City further agrees to make all necessary efforts in complying with the requirements of said application and to further meet all necessary requirements to obtain approval and implementation of said grant should said grant be approved by the respective government agencies involved in the application and approval of said grant.
2. Said CGI further agrees that, should said funding be obtained, that it will promptly complete all necessary requirements in order to begin the acquisition process and comply with all Federal and State regulations that are necessary to obtain said grant and to be responsible for all financial matters growing out of same and to hold the City harmless from any liability thereon.
3. The parties further agree that any funds obtained through the efforts of the City in the form of a Community Development Block Grant shall be used solely for the purpose of acquiring real estate to construct the 40-unit LMI residential housing complex in West Plains.
NOW, THEREFORE, in consideration of the mutual promises herein contained, the parties have hereunto caused this agreement to be executed on behalf of the City of West Plains, Missouri, and on behalf of the Carlson Gardner, Inc. by its duly elected and appointed officers the day and year first above written.
