A RESOLUTION TO VACATE STREET RIGHT-OF-WAY (HOME BUILDER’S ASSOCIATION – GOOD HARD DRIVE

 

Section 1: That there has been presented to the City Council of the City of West Plains, Missouri petitions (EXHIBIT A) signed by the owners of all fee interests of record in all tracts of real property located within the area described in the petitions attached to right of way on the South and West Sides of property located on Good Hard Drive and further described as follows:

 

A part of the SW ¼ of Section 16, Township 24 North, Range 8 West described as follows:

 

All that part of a public road adjacent to the south side of Lots 6, 7, 8, 9, and 10 and adjacent to the west side of lots 10 and 11 of Powell’s Subdivision as recorded in Plat Book B, Page 8 of the records of Howell County, Missouri.

 

Section 2: That this request was reviewed and recommended by the Planning Commission to vacate 40’ of street right-of way on the south retaining utility easements and all on the west side.

 

Section 3: A public hearing shall be held concerning this matter and shall be held at 7:00 P.M. June 17, 2002 at the Public Library in West Plains, Missouri.

 

Section 4: The City Clerk is authorized and directed to cause a notice of such hearing to be published at least seven (7) days prior to the date of hearing in a newspaper of general circulation in Howell County, Missouri, which is qualified to publish legal matters.

 

Section 5: That this Resolution shall be in full force and effect from and after its passage and approval.
