A RESOLUTION AUTHORIZING A CONSULTANT AGREEMENT BY AND BETWEEN THE CITY OF WEST PLAINS, MISSOURI AND HEARTLAND STRATEGIES FOR MUNICIPAL DEVELOPMENT SERVICES
WHEREAS, the City Council of the City of West Plains, Missouri desires to enter into a written agreement with Heather Wakefield Fisher dba Heartland Strategies for services related to the development of the municipality; and
WHEREAS, the City Council of the City of West Plains, Missouri deems it wise and necessary to pass this Resolution authorizing this agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:
Section 1: That the City Council of the City of West Plains, Missouri does hereby authorize the agreement by and between the City of West Plains and Heather Wakefield Fisher dba Heartland Strategies a true copy of said agreement attached hereto and made a part hereof to be known as AEXHIBIT A@.
Section 2: That this Resolution shall be in full force and effect after its days of passage and approval.

CONSULTANT AGREEMENT
THIS AGREEMENT effective this ______ day of _____________________, 2002, by and between the City of West Plains, Missouri (hereinafter referred to as City) and Heather Wakefield Fisher (hereinafter referred to as Consultant).
WHEREAS, the City desires to have the Consultant perform services related to the development of the municipality, grant proposals, and implementation of a strategic plan; and
WHEREAS, the City desires to contract with the Consultant for specific tasks on mutually agreed projects in order to further the goals of the City;
NOW THEREFORE, the City will contract with the Consultant, and Consultant agrees to be contracted on the following terms and conditions:
1. TERM OF CONTRACT. Employment will begin on August 19, 2002, and will be in effect for a period of one year, until August 19, 2003, and will automatically renew upon mutual consent of the City and Consultant.
2. SCOPE OF SERVICES. City will contract with the Consultant for specific projects, enumerated in the attached work plan, and additional mutually agreed upon projects. Scope of services may be reasonably changed, increased or reduced upon mutual written agreement of the City and Consultant. Consultant will devote an average of 20 hours a week to City projects.
3. CONSULTATION AND REPORTS. City’s designated representative for consultation and communication shall be Mayor Joe Paul Evans and City Administrator Royce Fugate, PE, or other person or persons as designated in writing to the Consultant. Consultant shall attend regular meetings of the Land Clearance Authority and Planning Commission, and such other meetings as deemed necessary, and shall give a monthly report to the City.
4. COMPENSATION. Consultant will be reimbursed monthly at a minimum of $30.00 per hour and/or a percentage fee, depending on the project. Consultant will submit monthly invoices of work completed and hours spent on projects.
5. EXPENSE REIMBURSEMENT. Consultant may incur reasonable expenses, including expenses for travel, postage, copies, etc., which will be reimbursable by the City. Mileage from Consultant’s office to West Plains City Hall, Chamber of Commerce, or other necessary meeting places will be reimbursed at the federal rate of 36.5cents a mile. Consultant shall tender a statement of expenses and City agrees to reimburse Consultant within 30 days of receipt of statement.
6. WORK LOCATION. Consultant will work from her home office, however, as special projects occur and meeting or workspace is needed at City Hall, a space shall be provided at the City’s convenience. Consultant will have access to City’s copy machine, fax machine, computer and Internet system, and telephone as needed to facilitate the execution of specific projects.
7. CONFIDENTIALITY. Since the issues and items that the Consultant will be dealing with on behalf of the City shall, at times, be of a confidential nature, Consultant agrees that during the term of her contract, not to reveal the confidential information, or any other information of the City received in confidence during the term of this agreement, to any person, firm, corporation, association, or any other entity.
8. TERMINATION. Performance under this agreement may be terminated by Consultant or the City upon thirty (30) days’ written notice. Upon termination, the Consultant shall be reimbursed for all costs and non-cancelable commitments incurred in the performance of the contract.

2. Research grants and revolving funds for neighborhood improvements for the Land Clearance Housing and Redevelopment Authority.
3. Work on developing and implementing Home Rule Commission form of government.
6. Research Planning and Zoning options and report findings to the commission.
