RESOLUTION TO VACATE PART OF A CUL-DE-SAC (BRILL, FINCH, BAILEY, SMITH)
Section 1: That there has been presented to the City Council
of the City of West Plains, Missouri petitions (EXHIBIT A) signed by the owners
of all fee interests of record in all tracts of real property located within
the area described in the petitions attached to right of way on the Harrison
Circle Cul-de-Sac further described as follows:
Tract
#1: A part of the cul-de-sac at the end
of Harrison Circle in Block 2 of Suburban Estates First Addition, as shown in
Plat Record G, at pages 85 and 86 of the records of Howell County, Missouri,
more particularly described as follows:
Commencing at the southwest corner of Lot 12, Block 2, thence North
14°4859West, 102.52 feet to the POINT OF BEGINNING: thence along the arc of a curve to the left 76.06 feet, said
curve having a radius of 60.00 feet and a chord bearing North 14°3624 East;
thence South 68°1726 West, 19.86 feet; thence along the arc of a curve to the
right 48.76 feet, said curve having a radius of 50.00 feet and a chord bearing
South 04°1726 West, 19.86 feet; thence along the arc of a curve to the right
48.76 feet, said curve having a radius of 50.00 feet and a chord bearing South
04°0629 West; thence South 14°4859: East, 15.20 feet to the point of
beginning containing 1,063.8 sq. ft. more or less as shown by survey no. 02045
by Burgess Land Surveying, L.L.C.

said curve having a radius of 60.00 feet and a chord bearing North 39°11 58
West to the POINT OF BEGINNING: thence
along the arc of a curve to the left 86.97 feet, said curve having a radius of
60.00 feet and a chord bearing South 09°0855 West; thence along the arc of a
curve to the right 82.47 feet, said curve having a radius of 50.00 feet and a
chord bearing North 14°5227 East; thence North 39°1918 West, 9.78 feet to
the point of beginning containing 297.8 sq. ft. more or less as shown by survey

more particularly described as follows:
Commencing at the southwest corner of Lot 12, Block 2, thence North
14°4859 West 102.52 feet; thence along the arc of a curve to the left 275.72
feet, said curve having a radius of 60.00 feet and a chord bearing North
80°4310 West to the POINT OF BEGINNING:
thence along the arc of a curve to the left 49.90 feet, said curve
having a radius of 60.00 feet and a chord bearing south 56°1212 East; thence
North 14°3650 West, 3.94 feet; thence along the arc of a curve to the right
47.35 feet, said curve having a radius of 50.00 feet and a chord bearing North
59°2942 West to the point of beginning containing 61.0 sq. ft. more or less
as shown by survey no. 02045 by Burgess Land Surveying. LLC.
Section 2: That this request was reviewed and recommended by
the Planning Commission to vacate this portion of street right-of way.
Section 3: A public hearing shall be held concerning this matter and shall be held at 7:00 P.M. November 18, 2002 at the Public Library in West Plains, Missouri.
Section 4: The City Clerk is authorized and directed to cause
a notice of such hearing to be published at least seven (7) days prior to the
date of hearing in a newspaper of general circulation in Howell County,
Missouri, which is qualified to publish legal matters.
Section 5: That this Resolution shall be in full force and
effect from and after its passage and approval.
