BILL NO. 624 RESOLUTION ________
A RESOLUTION CONCERNING VOLUNTARY ANNEXATION (PHYSICIANS ACUMEN ENTERPRISES, S. BUSINESS 63).
WHEREAS, the availability of city water and sewer utility service is essential to the proper development of the Physicians Acumen Enterprises project; and
WHEREAS, a separate real estate development agreement is being proposed in the event the annexation process is not approved; and
WHEREAS, the Planning Commission and City administration recommended this agreement which is submitted to City Council by Bill 3783 on November 25, 2002.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST PLAINS, MISSOURI AS FOLLOWS:
Section 1: That there has been presented to the City Council of the City of West Plains, Missouri, a verified petition signed by the Owner of all fee interests of record in all tracts of real property located within the area described in the petition, which area is proposed to be annexed to the City of West Plains, Missouri, and which petition requests annexation of such area into the City limits of the City of West Plains, Missouri as C-2 (General Commercial) a true copy of such petition is attached (Exhibit A) for approximately 20 acres of property located on the north side of S. Business 63.
Section 2:
That no part of the said real property is now included in any incorporated
municipality.
Section 3: That, in accordance with Section 71.012 RSMo, a public hearing shall be held concerning the matter and this Public Hearing shall be held December 16, 2002 at 7:00 p.m. at the Public Library in West Plains, Missouri.
Section 4: The City Clerk is authorized and directed to cause a notice of such hearing to be published at least seven (7) days prior to the date of hearing in a newspaper of general circulation in Howell County, Missouri, which is qualified to publish legal matters.

5: That this Resolution shall be in full force and effect from and after
its passage and approval
