WEST PLAINS CITY COUNCIL

REGULAR MEETING

January 20, 2009

 

The West Plains City Council met for a regular meeting at 7:00 p.m. on Tuesday, January 20, 2009 at West Plains City Hall Council Chambers, 1910 Holiday Lane with the following members present: Mayor Joe Paul Evans, Councilman Jack Pahlmann, Councilman Louis Citro, Councilman Jim Goss, and Councilman Bob Burtrum. City Administrator/Engineer Royce Fugate, P.E., City Clerk Mallory Prewett, Finance Director Dixie Williams, and City Attorney Charles Cantrell were also present. This was the first meeting in the new City Hall Council Chambers and the first time the City has ever had a formal Council Chambers.

 

 

I.          PRELIMINARIES:

 

Mayor Evans established a quorum and called the meeting to order.  Councilman Citro led the Pledge of Allegiance and Pastor Mark Mildren, First United Methodist Church, gave the invocation of the first meeting held in the Council Chambers.

           

II.        APPROVAL OF MINUTES:

 

The motion was made by Councilman Goss and seconded by Councilman Citro to approve the minutes for the December 15, 2008 Regular Meeting. Motion passed unanimously.

 

III.       CONSIDERATION OF PAYROLL AND BILLS:

 

The motion was made by Councilman Pahlmann and seconded by Councilman Citro to approve payment for the payrolls of December 19, 2008, December 31, 2008, and January 16, 2009 and also bills for December 2008.  Motion passed unanimously.

 

IV.       RECOGNITION OF GUESTS:

           

            City Administrator Fugate and Assistant Police Chief Jones presented James Looney with a proclamation. Mr. Looney read a thank you note to the City Council, Mayor, City Administrator, and other employees.

 

            Boy Scout Troop 160 was present to earn their Citizenship and Merit badges.        

 

            Mayor Evans briefly addressed the historic day in West Plains. January 20, 2009 marked the first day the Council Chambers were being used. He stated he was proud of West Plains for having this beautiful building, a nice park, Fire Departments, the Senior Citizen Building, and others. Mayor Evans said, “West Plains is a vibrant, progressive City, and we should be proud.”

 

           

V.        READING OF BILLS:

                                       

A.    Bill 4096 to become Ordinance 4096. Second Reading. An Ordinance changing the official zoning map of the City of West Plains, Missouri and defining the boundaries of the area of to be changed on said official zoning map by this Ordinance (Billy Sexton, 675 Missouri Avenue, North of Williams and West of Missouri Avenue.) The motion was made by Councilman Citro and seconded by Councilman Pahlmann to accept Bill 4096, which becomes Ordinance 4096. Motion passed.

B.     Bill 4097 to become Ordinance 4097. First and Second Reading. An Ordinance authorizing a lease agreement by and between the City of West Plains, Missouri and Mark Dake/Straight Aviation for land to occupy an airport hangar. The motion was made by Councilman Burtrum and seconded by Councilman Citro to accept Bill 4097, which becomes Ordinance 4097. Motion passed unanimously.

C.    Bill 4098 to become Ordinance 4098. First and Second Reading. An Ordinance approving the adoption of budget for Stormwater Management Program for the remainder of the fiscal year beginning  April 1, 2008 and ending March 31, 2009. The motion was made by Councilman Goss and seconded by Councilman Burtrum to accept Bill 4098, which becomes Ordinance 4098. Motion passed.

D.    Bill 4099 to become Ordinance 4099. First and Second Reading. An Ordinance to authorize the Mayor to apply for federal financial assistance on behalf of the city of West Plains and to execute any contract(s) resulting from such application for any grant between the City of West Plains and Missouri Highways and Transportation Commission providing for capital, comprised of federal funds to be expended for commission-approved transit project. The motion was made by Councilman Citro and seconded by Councilman Pahlmann to accept the Bill 4099, which becomes Ordinance 4099.

E.     Bill 880 to become Resolution 880. A Resolution amending the Safety Policy Manual under Section V: Safety Equipment, 4-Protective Clothing, adding part F. The motion was made by Councilman Pahlmann and seconded by Councilman Citro to accept Bill 880, which becomes Resolution 880. Motion passed unanimously.

 

F.     Bill 881 to become Resolution 881. A Resolution adopting a policy for retirees in regard to health and dental insurance coverage in order to comply with GASB 45.  

The motion was made by Councilman Burtrum and seconded by Councilman Pahlmann to accept Bill 881, which becomes Resolution 881. Motion passed unanimously.

 

G.    Bill 882 to become Resolution 882. A Resolution authorizing written agreements by and between the City of West Plains, Missouri and Benny Butler which agreement pertains to the leasing of an airport hangar. The motion was made by Councilman Pahlmann and seconded by Councilman Citro to accept Bill 882, which becomes Resolution 882. Motion passed unanimously.

 

VI. COUNCIL ACTION

 

A.    Bid—100a Cutouts for Electric Department

The motion was made by Councilman Goss and seconded by Councilman Burtrum to accept the bid from Graybar of Jefferson City, MO for $4,200.00. Motion passed unanimously.

The motion was made by Councilman Pahlmann and seconded by Councilman Burtrum to accept the bid from Grennan Telephone Alarm Systems for $5,020.00. This acceptance is subject to negotiating on microphones. Motion passed unanimously.

H.    Planning and Zoning Recommendations

The motion was made by Councilman Pahlmann and seconded by Councilman Citro to accept the Planning and Zoning Recommendations for the Guffey West Plains Properties LLC, West Plains Marketplace Minor Subdivision, First Addition. Motion passed unanimously.

 

VII    ADMINISTRATOR’S REPORT

 

A.     Project Updates

·         The curb and guttering project on Catalina is complete. The Street Department is currently working on driveways so people can get back into them.

·         The new City Hall/Council Chambers is finished, but we are waiting on a few more things. The parking lot needs to be completed and the court will move out once the trailers are gone and the rest of the interior is complete.

·         House Bill 1549, E-Verify, as we look into it any contract over $5,000, even contractors, must follow E-Verify. E-Verify has been postponed until February 20, 2009 for federal contracts.

·         As for the liquor license on the agenda, there is nothing in the Code book that addresses this type of license. I recommend we see if the business is able to get a state license and then we will discuss giving a City license.

·         Air Evac Membership fee on utility bills: Air Evac has low membership in southern Missouri. Air Evac approached the City to allow citizens to pay monthly on the City utility bills, adding a $5 fee for 12 months, totaling $60. The Council and Mr. Fugate decided against this, because it would open opportunities for other organizations to approach us for billing purposes as well.

 

VIII. MISCELLANEOUS

 

A.    The Council discussed the open house date for the new City Hall/Council Chambers. It was decided it could possibly be a Tuesday or Thursday from 4 to 6 p.m. or 5 to 7 p.m.

B.     Mr. Fugate asked the Council’s permission to sign a confidentiality agreement with Westar Energy. Council agreed.

 

IX. ADJOURN

 

The motion was made by Councilman Pahlmann and seconded by Councilman Burtrum to adjourn. Motion passed unanimously.
