The West Plains City Council met for a regular meeting at 7:00 p.m. on Monday, September 21, 2009 at West Plains City Hall Council Chambers, 1910 Holiday Lane with the following members present: Mayor Joe Paul Evans, Councilman/Mayor Pro-Tem Jack Pahlmann, Councilman Lou Citro, Councilman Jim Goss, and Councilman Bob Burtrum. City Administrator/Engineer Royce Fugate, P.E., City Clerk Mallory Prewett, Finance Director Dixie Williams, and City Attorney Charles Cantrell were also present.
Mayor Joe Paul Evans established a quorum and called the meeting to order. City Attorney Charles Cantrell said the invocation and Councilman Citro led the Pledge of Allegiance.
The motion was made by Councilman Pahlmann and seconded by Councilman Citro to approve the minutes for the August 24, 2009 Regular Meeting.
III. CONSIDERATION
OF PAYROLL AND BILLS:
The motion was made by Councilman Citro and seconded by Councilman Goss to approve payment for the payrolls of August 28, 2009, September 11, 2009, and bills for August 2009. Motion passed unanimously.
IV. Andy Marmouget of
Davis, Lynn, & Moots Audit Report
Andy Marmouget reported that Davis, Lynn, and Moots has completed the audit and reflects the auditor’s “clean opinion.” A report was given to each Councilmember and was gone over during the meeting.
V. RECOGNITION OF
GUESTS
A. Ruth J. Smith, 1940 Meadow Drive, West Plains, Missouri.
a. Ms. Smith proposed the idea of the “averaged utility bill” to the Council. She said it would help people with a fixed income to know how much they can count on each month to pay. She proposed it could be offered to people with good payment history. Councilman Pahlmann stated our computer software wouldn’t easily allow this and that the citizen could do it themselves, by paying their bills such that they would have a credit.
VI. READING OF BILLS:
A. Bill 4126 to become Ordinance 4126. First Reading. An Ordinance changing the
official zoning map of the City of West Plains, Missouri and defining the
boundaries of the area to be changed on said official zoning map by this
Ordinance (north of East Main Street, east of Howell Avenue and west of College
Street—Kirt & Alan Ramseur). The motion was made by Councilman Burtrum and
seconded by Councilman Pahlmann to approve the first reading of Bill 4126,
which will become Ordinance 4126. Motion passed unanimously.

B. Bill 4127 to become Ordinance 4127. First and Second Reading. An Ordinance to
authorize the Mayor to apply for federal financial assistance on behalf of the
City of West Plains and to execute any contract(s) resulting from such
application for any grants between the City of West Plains and Missouri
Highways and Transportation Commission providing for planning assistance,
comprised of federal funds to be expended for commission-approved transit
projects. The motion was made by Councilman Goss and seconded by Councilman Citro
to accept Bill 4127, which becomes Ordinance 4127. Motion passed unanimously.

and seconded by Councilman Citro to accept the first reading of Bill 4128,

to become Resolution 900. A Resolution authorizing the City of West Plains,
Missouri to execute a cooperative agreement by and between the City of West
Plains, Missouri, a Municipal Corporation and the Friends of Galloway Creek
Nature Park to host the Haunting in the Hollows event at Galloway Park. The
motion was made by Councilman Pahlmann and seconded by Councilman Citro to
accept Bill 900, which becomes Resolution 900. Motion passed unanimously.
H. Bill 901 to
become Resolution 901. A Resolution supporting an application by MACO
Development Company, LLC to the Missouri Housing Development Commission—Lambert
Lane and Bill Virdon Boulevard. The
motion was made by Councilman Citro and seconded by Councilman Burtrum to
accept Bill 901, which becomes Resolution 901. Motion passed unanimously.
VII. COUNCIL ACTION
A. Bid—Curbside Bins for Recycling Department
The motion was made by Councilman Pahlmann and seconded by Councilman Citro to accept the bid from Bag and Tag, Inc of Palos Heights, Illinois for $7,250. Motion passed unanimously.

C. Website
After trying to develop the City’s new website with Roger Good, the City
decided it was not practical to have the website redone on an hourly basis
because of the work involved. The City employees reassessed the previous bids,
plus another from Cape Girardeau. It was recommended to the Council to approve
David Johnston with DRJ Designs for $3,400 with training included. The motion
was made by Councilman Pahlmann and seconded by Councilman Goss to accept the
bid from DRJ Designs for $3,400. Motion passed unanimously.
D. Liquor License—Get and Go Mini Mart, LLC
The motion was made by Councilman Pahlmann and seconded by Councilman
Burtrum to grant the liquor license for Get and Go Mini Mart, LLC. Motion
passed unanimously.
E. Liquor License—One Stop Convenience
The motion was made by Councilman Goss and seconded by Councilman
Pahlmann to grant the liquor license for One Stop Convenience. Motion passed
unanimously.
F. Planning
and Zoning Recommendations
a. Ramseur request for rezoning property from
Residential (R-3) to Commercial (C-3) north of East Main Street, east of Howell
Avenue and west of College Street.
b. MACO Development request for rezone at 1268
Lambert Lane from Residential to (R-2) to Commercial (C-2).
c. Gary Frazier request to vacate Burke Avenue
cul-de-sac, tract #2 and #3.
d. Final Plat for Lowe’s Addition, an addition
to the City of West Plains, being part of the SW ¼, NW ¼, Section 32, T 24 N, R
8 W of the 5th P.M., Howell County, Missouri.

A. Reappoint Kevin Guffey, Clyde Stewart Jr., Jerry Hall, Guy Ramseur, and Rod Hamby to the Community Improvement District for four year terms ending September 2013.
B. Reappoint Paul Childers and Thom Sheridan to the Tax Increment Financing #3 Board for three year terms ending August 2012.
The motion was made by Councilman Pahlmann and seconded by Councilman Burtrum to reappoint all board members. Motion passed unanimously.
