WEST PLAINS CITY COUNCIL MEETING

Special Council Meeting
May 9, 2001

The City Council met for a special council meeting at 4:30 on May 9, 2001. Members present were Mayor Joe Paul Evans, Councilman Jack Pahlmann, Councilman Louis Citro, Councilwoman Judy North and Councilman Bob Burtrum. Also present were City Clerk Shelton and City Administrator Fugate.

I. PRELIMINARIES

Mayor Evans established a quorum and called the meeting to order at 4:30 p.m. City Administrator Fugate gave the invocation and Councilman Pahlmann led the pledge of allegiance.

II. COUNCIL ACTION

A. Silver Star Limo Conform Van – Vehicle for Hire License, George Saba

 Council informed Mr. Saba that he would need commercial liability insurance rather than personal. Council discussed the difference between this business, which is more of a specialty-type limo service, and a regular taxicab business and agreed to require only one vehicle to operate. The motion was made by Councilman Pahlmann and seconded by Councilman Citro to grant a vehicle for hire license to George Saba if required commercial insurance certificates are presented. Motion passed unanimously.

III. WORK SESSION

A. Nuisance Ordinance Discussion:

 Council discussed the following points regarding the draft nuisance ordinance:

 1. Might incorporate some of Union, Missouri ordinance.

 2. Require and hold 25% of insurance proceeds until the property is cleaned up after a fire, tornado, other natural disaster, etc. Several towns around this area do this (Thayer, Mountain View).

 3. Appeal process is complicated but important to keep in place.

 4. Change 7" height of grass to 12" before it is defined as a nuisance.

 5. Burning leaves is not permitted now (page 8) as recommended in the International Building Code. Exceptions have been made and citizens are asked to notify the police station.

 6. Sign should be placed in yards with the time limit posted as to when the deadline for demolition clean up. Page 9 V Should be a maximum of 90 days

 7. Need development plan (time limits) for land but this should go in the subdivision ordinance.

B. Park Recreation Tax

 Council discussed the need for the City to vote a 3/8 transportation tax later and whether or not people would support both a ¼ cent recreation tax and a 3/8 transportation tax. Inherited street problems from new subdivisions have made this a priority for the City.

 Park Board Member Chuck Robson said that a survey taken recently convinced them that the public supports a ¼ cent recreation tax and also shaped the list of capital improvements that need to be made for the parks.

 Park Board Member Myles Smith asked whether the $57,000 that goes to the Golf Course (15% of their 15% general sales tax) is being used for debt service. Council replied that it is being used for operating expense at the golf course but that after the new nine opens, it is hoped that revenue will increase and the money could then go to debt service. Increasing rates at the course was discussed.

 The pool deficit and the high cost of operating the soccer program were discussed.

 Different options for the general fund tax/recreation tax were discussed (copy attached).

 Property purchase on Creamery Road was discussed for additional ball fields and soccer fields.

 It was agreed that the percentage rate for the recreation tax ordinance would be left blank and completed May 21 at the Council meeting.

IV. MISCELLANEOUS

Mr. Fugate announced that Associated Electric would be here for a meeting at 9:30 on May 30. He invited council to attend.

V. ADJOURN

The motion was made by Councilman Pahlmann and seconded by Councilman Citro to adjourn.
