WEST PLAINS CITY COUNCIL MEETING

July 22, 2002

 

The West Plains City Council met in regular session on July 22, 2002 at West Plains Public Library, 750 West Broadway with the following members present: Mayor Joe Paul Evans, Councilman Jack Pahlmann, Councilman Louis Citro, Councilwoman Judy North, Councilman Bob Burtrum, City Administrator/Engineer Royce Fugate, P.E., City Clerk Connie Shelton, and City Attorney Charles Cantrell.

 

I.            PRELIMINARIES:

 

Mayor Evans established a quorum and called the meeting to order at 7:00 p.m. Police Chief Chuck Brotherton gave the invocation and Councilman Citro led the Pledge of Allegiance.

 

II.            APPROVAL OF MINUTES:

 

The motion was made by Councilman Burtrum and seconded by Councilman Pahlmann that the minutes of June 17, 2002 regular meeting and July 2, 2002 special meeting be approved.  Motion passed unanimously.

 

III.            CONSIDERATION OF PAYROLL AND BILLS:

 

The motion was made by Councilwoman North and seconded by Councilman Citro to approve payment for the payrolls of June 25 and July 9, 2002 and bills for June 2002.  Motion passed unanimously.

 

IV.            CONSIDERATION OF FINANCIAL STATEMENT:

 

City Clerk Connie Shelton gave a financial report for the period ending June 30, 2002 (copy attached).

 

V.               RECOGNITION OF GUESTS

 

 

A.                Tim Hagen-Public Health and Sanitation Meeting, General Update on Inspections and Update on West Nile Virus

Tim Hagen reported that the 3rd annual sanitation workshop for food handlers would be held August 19 in the Civic Center.  He also presented information on the West Nile Virus and the importance of protection against mosquitoes.

 

 

 

 

VI.            READING OF BILLS:

 

A.                 Bill No. 3761 to become Ordinance No. 3761 vacating Amber Place and Brittany Place (Morrison Subdivision – Mearl Frazier and Jerry Hall) was given second reading.  The motion was made by Councilman Pahlmann and seconded by Councilman Citro that the second reading of Bill 3761 be accepted and become Ordinance No. 3761. Motion passed unanimously.

B.     Bill No. 3762 to become Ordinance No. 3762 to change the official zoning map of the City of West Plains, Missouri and defining the boundaries of the area to be changed on said official zoning map by this ordinance (Home Builders Association M-2 to C-2, Good Hard Drive) was given second reading.   The motion was made by Councilman Burtrum and seconded by Councilwoman North that second reading of Bill 3762 be accepted and become Ordinance 3762.  Motion passed unanimously.

C.     Bill No. 3763 to become Ordinance No. 3763 to vacate a portion of street right-of-way (Home Builder’s Association-Good Hard Drive) was given second reading.  The motion was made by Councilman Citro and seconded by Councilman Burtrum that the second reading of Bill 3763 be accepted and become Ordinance 3763.  Motion passed unanimously.

D.    Bill No. 3764 to become Ordinance No. 3764 authorizing the Mayor of the City of West Plains, Missouri to execute an amendment to an agreement on behalf of the City with Missouri Highway and Transportation Commission for a grant to fund a general public transportation project to be funded under Chapter 53(5311) of Title 49, United States code was given first and second reading.  The motion was made by Councilman Pahlmann and seconded by Councilman Citro that first and second reading of Bill 3764 be accepted and become Ordinance No. 3764.  Motion passed unanimously.

E.     Bill No. 3765 to become Ordinance No. 3765 to annex property as C-2 zone (Cary Stewart, Clyde Stewart III) was given first reading.  City Administrator Fugate reported that he contacted the Public Water District and they do not have an objection to the City furnishing water to this property.  The motion was made by Councilman Burtrum and seconded by Councilman Citro to accept the first reading of Bill 3765.  Motion passed unanimously.

F.      Bill No. 3766 to become Ordinance No. 3766 revoking Article XI, All Terrain Vehicles, Section 90-559 (3) Use on City Streets, Permits Issued and enacting a new Section 90-559 (3) Parades in the Code of Ordinances was given first reading.  The motion was made by Councilman Citro and seconded by Councilwoman North to accept the first reading of Bill 3766.  Motion passed unanimously.

G.    Bill No. 3767 to become Ordinance No. 3767 revoking or changing certain section of Division 2: Parking for the Disabled, Section 90-336, licenses and stickers, code of ordinances was given first reading. The motion was made by Councilman Citro and seconded by Councilman Burtrum to accept the first reading of Bill 3767.  Motion passed unanimously.

A.                Approval of Request to Destroy Records

 

The motion was made by Councilman Pahlmann and seconded by Councilman Citro to destroy records as listed (copy attached).  Motion passed unanimously.

 

B.        Liquor License Application-Tavern-Travelodge

                                   

            The motion was made by Councilman Pahlmann and seconded by Councilman Burtrum to approve a tavern liquor licenses for Travelodge.  Motion passed unanimously.           

 
C.        Electronic Electric Meters for Inventory

                                The motion was made by Councilwoman North and seconded by Councilman Burtrum to accept the bid of Downing Sales for $2,977.00.  Motion passed unanimously.

Purchasing Agent Dave Hoglen reported that MDS did not meet bid specifications. This Equipment has a 50% grant match from the state.  The motion was made by Councilman Pahlmann and seconded by Councilman Citro to accept the bid of ARS for $3,145.00.  Motion passed unanimously.

 

 

J.                  Bid – Trailer for Street Construction

The motion was made by Councilman Citro and seconded by Councilman Burtrum to accept the bid of Fire Master for $500.00.  Motion passed unanimously.

The motion was made by Councilman Burtrum and seconded by Councilman Citro to accept the bid of Bob’s Equipment for $6,500.00.  Motion passed unanimously.

 

            O.            Planning Commission Recommendations

1.                  Raymond and Donna Carlson, Conditional use for Manufactured Home on Permanent Foundation R-3 Zone

 

The motion was made by Councilwoman North and seconded by Councilman Burtrum to approve a conditional use for a manufactured home for the Raymond and Donna Carlson property.  Motion passed unanimously.

 

2.                  Sue Sturgeon, Sue’s Barber Shop-Conditional Use Permit for Business in R-2 Zone

 

The motion was made by Councilman Pahlmann and seconded by Councilman Citro to approve conditional use permit for a barber shop in R-2 zone for Sue Sturgeon with a sign size of 4 square foot (non-illuminated) for the front yard and also a wall sign.  Motion passed unanimously.

 

                                                                       

VIII.                ADMINISTRATOR’S REPORT

 

                       

A.               AECI Billing Error – Power Costs City Administrator Fugate reported that Associated Electric recently notified the City that power billing errors have been made over a period of time that will amount to $53,624 additional cost to the City.  He said many negotiations have taken place and Electric Supervisor Jim Davidson has verified their calculations.

B.            Pothole Patcher – The patch truck operator will demonstrate the procedure on Minnesota Avenue Tuesday, July 23. He invited Council and the public to watch.  Council members agreed to meet during special session later in the week to consider purchase of this equipment.

C.            Heartland Strategies Contract:  City Administrator Fugate said that a contract with Heather Wakefield Fisher of Heartland Strategies would be on the August agenda.

D.            Audit Report Egan, Mangold, and Shultz will make the annual audit report during the August meeting.

E.            Police Roof Repairs: During construction of the safety complex roof, a storm damaged the roof and also did some interior damage.  West Plains Roofing will take care of this expense.

 

IX.                   MISCELLANEOUS

 

A.                 Appointments to the Library Board – Unexpired term of Melonie Bunn July 2003 Propose Jane Streff

 

The motion was made by Councilman Pahlmann and seconded by Councilwoman North to propose Jane Streff to the Library Board for a term to expire July 2003.  Motion passed unanimously.
