WEST PLAINS CITY COUNCIL MEETING

City Council Meeting
September 17, 2001

The West Plains City Council met in regular session on September 17 2001 at West Plains Public Library, 750 West Broadway with the following members present: Mayor Joe Paul Evans, Councilman Jack Pahlmann, Councilwoman Judy North, Councilman Louis Citro, Councilman Bob Burtrum, City Administrator/Engineer Royce Fugate, P.E., City Clerk Connie Shelton, and City Attorney Charles Cantrell.

I. PRELIMINARIES

Mayor Evans established a quorum and called the meeting to order at 6:00 p.m. Council adjourned to closed session.Rev. Mark Mildren gave the invocation. Councilman Burtrum led the Pledge of Allegiance.

II. ADJOURN TO CLOSED SESION FOR PERSONNEL DISCUSSION RSMo 610.021(3)

III. OPEN SESSION - PRELIMINARIES

At 7:00 p.m. Warren Fletcher gave the invocation. Councilman Citro led the Pledge of Allegiance.

Public Hearings

A. Robert Moore, Linda Moore, Sue Waggoner, Vacate a portion of West Street. There was no comment from the audience.

B. Rollin Smith, Rezone 311 Pine Street from R-1 Single Family Residential to C-2 General Commercial. There was no comment from the audience.

C. Laurel Thompson, Loretta Carter, Howell County, Annex 38 acres and a portion of County Road 8620 (zone A-1) County Road 8620 and east of Highway 17. There was no comment from the audience.

IV. APPROVAL OF MINUTES

The motion was made by Councilwoman North and seconded by Councilman Burtrum that the minutes of August 20, 2001 regular meeting and August 27, 2001, September 5, 2001 special meetings be approved as corrected. Motion passed unanimously.

V. CONSIDERATION OF PAYROLL AND BILLS

The motion was made by Councilman Citro and seconded by Councilman Pahlmann to approve payment for the payrolls of August 21, 2001 and September 4, 2001 and bills for August 2001. Motion passed unanimously.

VI. CONSIDERATION OF FINANCIAL STATEMENT

City Clerk Connie Shelton presented a 15-year balance sheet comparison.

VII. RECOGNITION OF GUESTS

A. Mayor Evans recognized a group of students from Summersville, Missouri.

VIII. READING OF BILLS

A. A. Bill No. 3730 to become Ordinance No. 3730 prohibiting the parking of motor vehicles on the east side of Missouri Avenue between Thornburg and 908 Missouri Avenue and a short portion on the West side of Missouri Avenue curb across from 908 Missouri Avenue was given second reading. City Administrator Fugate reported that there has been no comment from people in the neighborhood. The motion was made by Councilman Pahlmann and seconded by Councilman Burtrum that second reading of Bill No. 3730 be accepted and become Ordinance No. 3730.

B. Bill No. 3731 to become Ordinance No. 3731 vacating a portion of Leyda Street between South Hill and Walnut (First Baptist Church) was given second reading. The motion was made by Councilman Burtrum and seconded by Councilman Citro that second reading of Bill No. 3731 be accepted and become Ordinance 3731.

C. Bill No. 3732 to become Ordinance No 3732 increasing water rates for city and rural customers was given second reading. The motion was made by Councilman Pahlmann and seconded by Councilman Citro that second reading of Bill No. 3732 be accepted and become Ordinance 3732.

D. Bill No. 3733 to become Ordinance No. 3733 to change the official zoning map from R-1 (Single Family Residential) to C-2 (General Commercial), 311 Pine Street-Rollin Smith was given first reading. The motion was made by Councilman Citro and seconded by Councilman Burtrum that first reading of Bill No. 3733 be accepted and become Ordinance No. 3733.

E. Bill No. 3734 to become Ordinance 3734 concerning voluntary annexation (Laurel Thompson, a Portion of County Road 8620, and Loretta Carter) was given first reading. The motion was made by Councilman Burtrum and seconded by Councilman Pahlmann that first reading of Bill No. 3734 be accepted and become Ordinance No. 3734.

F. Bill No. 3735 to become Ordinance No. 3735 to vacate a portion of West Street (Robert and Linda Moore, Sue Waggoner) was given first reading. After reviewing maps showing a short portion of West Street still not vacated, Council agreed that the property owner should be contacted regarding a petition to vacate. The motion was made by Councilman Pahlmann and seconded by Councilman Burtrum that the first reading of Bill No. 3735 be accepted.

G. Bill No. 3736 to become Ordinance No. 3736 adding a new Article VI to Chapter 29, Utilities, Private Wells Prohibited was given first reading. Council agreed to add grandfathering in wells already in the planning stages. A letter from the Country Club has been received indicating they have already begun the process for irrigation well. The motion was made by Councilman Pahlmann and seconded by Councilman Burtrum that the first reading of Ordinance No. 3736 be accepted.

Bill No. 3737 to become Ordinance No. 3737 providing for the assistance of twenty-five dollars as costs against any person convicted of an intoxication-related offense, as provided in Section 577-023 RSMo for credit to the State of Missouri spinal cord injury fund was given first and second reading. The motion was made by Councilman Citro and seconded by Councilman Pahlmann that Bill No. 3737 is now Ordinance No. 3737.

I. Bill No. 580 to become Resolution No. 580 concerning voluntary annexation (Don and Charlotte Jennings-Creamery Road) was read. The motion was made by Councilman Pahlmann and seconded by Councilman Citro that Bill No. 580 is now Resolution No. 580. Motion passed unanimously.

J. Bill No. 581 to become Resolution No. 581 authorizing the sale of real estate by the City of West Plains, Missouri, a municipal corporation to Joyce France, for certain real estate located in the City of West Plains, Howell County, Missouri was read. The motion was made by Councilman Pahlmann and seconded by Councilman Citro that Bill No. 581 is now Resolution No. 581. Motion passed unanimously.

K. Bill No. 582 to become Resolution No. 582 to show unity with and offer support for the government of the United States of America against terrorism of any kind was read. The motion was made by Councilman Burtrum and seconded by Councilman Pahlmann that Bill No. 582 is now Resolution No. 582. Motion passed unanimously.

IX. COUNCIL ACTION

A. Application for Resort Liquor License – Bob Trautman, Grapevine Grocer

The motion was made by Mayor Evans and seconded by Councilman Citro to approve the application for a resort liquor license for Bob Trautman. Motion passed unanimously.

The motion was made by Councilman Burtrum and seconded by Councilman Citro to accept the bid of Water Products for $2,517.00. The motion passed unanimously.

The motion was made by Councilman Citro and seconded by Councilman Pahlmann to accept the bid from U. S. Filter for $768.71. Motion passed unanimously.

The motion was made by Councilman Citro and seconded by Councilman Burtrum to accept the bid of West Plalins Computer for $3,267.00. Motion passed unanimously.

The motion was made by Councilman Burtrum and seconded by Councilman Pahlmann to accept the bid of Tate Equipment for $4,200.00. Motion passed unanimously.

The motion was made by Councilman Citro and seconded by Councilman Burtrum to accept the bid of Dickey's for $7,975.73. Motion passed unanimously.

J. Planning Commission Recommendations

Don Dias, Conditional Use Permit for Salon and Spa R-2 Zone, 773 Missouri Avenue

 The motion was made by Councilman Pahlmann and seconded by Councilman Citro to grant a conditional use permit for a salon and spa at 773 Missouri Avenue as recommended by the Planning Commission. Motion passed unanimously.accept the Preliminary Plat Subdivision of 5.6 acres with 3 tracts from Richard and Helen Atkinson as recommended by Planning Commission with the stipulation that a 20” utility easement be retained between lots 2 and 3. Motion passed unanimously.

X. Administrator’s Report

City Administrator Fugate reported as follows:

· He would look into an efficiency study for city departments

· Sanitation Supervisor Dennis Sloan has been asked to serve on a state stockholders group, which will help draft policy on sanitation issues

· The National League of Cities conference is coming up soon if Council would like to go

· West Plains has been designated as a storm ready city with a ceremony on October 12 at 11:00,

· The skateboard park committee met their goal of $50,000 in donations

· Tim Bean was promoted to Fire Chief in the closed session held at 6:00

XI. Miscellaneous

A. Appoint Kris Norman to Tourist Development Board as Chamber Representative - Term to Expire November 2006.

Motion was made by Councilman Pahlmann and seconded by Councilman Citro to appoint Kris Norman as Chamber representative to the Tourist Development Board for a 5 year term. Motion passed unanimously.. Motion passed unanimously.
